Docomo Community Cycle "Chiyokuru" Terms of Use (Chiyoda City)
These are the Terms of Use for the bike-sharing service "Tokyo Wide Area (Chiyoda City)". Terms of use vary by area. For details, please check "Account" > "Service Terms of Use" within the official app.
Chapter 1: General Provisions
Article 1 (Definitions)
The terms used in these Terms shall have the following meanings.
- Attachment Control Panel: The control device for the lock installed on the Sharing Bicycle.
- Cycle Sharing System: A system that rents Sharing Bicycles to Members by checking them in and out of Ports during service hours.
- Sharing Bicycle: A bicycle provided by the Company for joint use, including Collaborative Sharing Bicycles during the implementation of the Wide-area Collaboration Policy specified in Article 4.
- Port: A location for the rental, return, and storage of Sharing Bicycles, including Collaborative Ports under Article 4.
- Individual Member: A person who enters into a Membership Agreement regarding the Cycle Sharing System with the Company based on Article 3.
- Corporate Member: A legal entity (business, non-profit, or public corporation) that has entered into a Membership Agreement based on Article 3.
- Member: A general term for Individual Members and Corporate Members.
- Corporate Designated User: An individual designated by a Corporate Member to use the system for the member's business.
- User: A general term for Individual Members and Corporate Designated Users.
- Authentication Card: A general term for dedicated IC cards, transportation IC cards, or Osaifu-Keitai registered in the system used for identification and unlocking.
- Osaifu-Keitai: A mobile phone with an embedded IC chip.
- Service Office: The base for maintenance and support, with contact info disclosed on the Company’s website.
- Jurisdiction: Chiyoda City and other areas in Tokyo as separately prescribed by the Company.

Article 2 (Application of Terms)
- 1. DOCOMO BIKESHARE, INC. ("the Company") shall, in the Chiyoda City Community Cycle project "Chiyokuru" ("the Project"), enter into a Membership Agreement with applicants to provide Sharing Bicycle rental services during the membership period. Matters not prescribed herein shall follow laws or general customs.
- 2. The Company may create a "User Guide." If there is any discrepancy, the "User Guide" shall take precedence.
- 3. These Terms apply to all Members. Corporate Members are responsible for ensuring compliance by their designated users and are jointly liable for all their actions.
Chapter 2: Membership Agreement
Article 3 (Conclusion of Membership Agreement, etc.)
- 1. Individuals must agree to these Terms and apply via the prescribed method. Minors must obtain prior parental/guardian consent.
- 2. Corporations must agree to these Terms and provide necessary information for designated users to apply.
- 3. An agreement is formed upon the Company’s acceptance. Plan details and updates will be published on the website at least one week before changes.
- 4. The Company may refuse an application if the applicant falls under any of the following:
- (1) Height is less than 145 cm.
- (2) The Company deems safe riding physically difficult.
- (3) Past rental fees are in arrears.
- (4) Belonging to an anti-social force/crime syndicate.
- (5) Under 13 and not agreeing to wear a helmet.
- (6)本規約に同意しないとき。
- (7) Any other reason the Company deems inappropriate.
- 5. Users are limited to Individual Members or Corporate Designated Users.
Article 4 (Conditions of Use / Wide-area Collaboration Policy)
- 1. Members shall select one plan and one payment method prescribed by the Company.
- 2. Members shall pay fees as prescribed in Chapter 5 based on their selected plan.
- 3. Port locations are published on the website.
- 4. The Company may implement a "Wide-area Collaboration Policy" allowing use of Collaborative Bicycles and Ports. Users can rent/return these across the entire jurisdiction. Usage must follow these Terms, and fees apply regardless of rental/return locations.
- 5. Specific terms for collaboration are determined separately. Usage may be restricted by the terms of collaborative operators.
- 6. The Company is not liable for damages if the collaborative system is unavailable, and fees will not be refunded.
Article 5 (Roaming Service)
- 1. Users may use Roaming Collaborative Bicycles and Ports in designated "Roaming Areas." These bicycles must be used and returned within the same Roaming Area. Renting in the jurisdiction and returning in a Roaming Area is prohibited; violation leads to liability for recovery costs and damages.
- 2. Roaming usage follows the terms of that specific area. Regardless of the contracted plan, "One-time Member" rates of the roaming area will apply.
- 3. No liability or refunds for unavailability of roaming services.
Article 6 (Changes to Registration Information, etc.)
- 1. Members must immediately notify and obtain Company approval for any changes to personal info, plans, or payment methods.
- 2. The Company may refuse changes or terminate the agreement if they hinder service operations.
Article 7 (Termination of Membership Agreement)
The Company may suspend service or terminate the agreement without notice if a User:
- (1) Violates these Terms or other agreements with the Company.
- (2) Causes a traffic accident during use.
- (3) Delays any payment even once.
- (4) Falls under any item in Article 3, Paragraph 4.
- (5) Is otherwise deemed unsuitable (e.g., loss of contact, false info).
Article 8 (Discontinuation of the Project)
- 1. The Company may unilaterally discontinue the Project if continuation is deemed difficult.
- 2. In such cases, the agreement ends upon notice, and base fees after termination are not required.
Article 9 (Cancellation)
Members may cancel with consent. Base fees apply up to the cancellation date, or until the end of the month for Corporate plans.
Article 10 (Effective Period of Membership Agreement)
The period lasts from signing until the end of the Project, unless specified otherwise by the selected plan.
Article 11 (Implementation Period of the Project)
Implementation periods are published on the website and may change without notice due to weather or operations.
Article 12 (Temporary Suspension and Resumption)
The Company may suspend services for safety (weather, events, etc.) with prior or subsequent notice. No refunds will be provided for suspension periods.
Article 13 (Management of ID, Password, etc.)
- 1. Users must manage IDs, passwords, and unlock codes responsibly and not disclose them to third parties.
- 2. The Company is not liable for mismanagement of credentials; all usage is deemed to be by the User.
- 3. Users must immediately notify the Company of any suspected theft or unauthorized use of credentials.
Article 14 (Authentication Card)
- 1. Users may use an Authentication Card for rental procedures.
- 2. Users must obtain and set up compatible cards at their own expense.
- 3. Cards must be handled with care and not used by third parties.
- 4. All card usage is deemed to be by the User.
- 5. Report any loss or damage of cards to the Service Office immediately.
- 6. Members bear the actual cost for card reissuance or registration.
Chapter 3: Rental and Return Procedures
Article 15 (Reservation and Cancellation, etc.)
- 1. Users may request reservations for specific ports and bikes. The Company will fulfill requests based on availability.
- 2. Reservations may be canceled if rental procedures are not completed within the designated time or if the bike becomes unavailable.
- 3. No claims shall be made against the Company for canceled reservations.
Article 16 (Bicycle Rental Procedures, etc.)
- 1. Rental is complete when the User unlocks the bike at a Port. This forms an Individual Agreement.
- 2. Rentals may be unavailable due to system issues or lack of bikes.
- 3. No claims for compensation or refunds if a bike is unavailable.
Article 17 (Bicycle Return Procedures, etc.)
- 1. Return is complete when the User locks the bike and sends a return notice via the control panel at a Port.
- 2. Check for personal items; the Company is not liable for lost belongings.
- 3. If a Port is full, the User must find another Port.
- 4. In emergencies, contact the Service Office and follow instructions.
- 5. Abandoning a bike without instruction means the return is not complete.
Article 18 (Cancellation of Individual Agreement)
The Company may demand immediate return if:
- (1) Service cannot continue due to bike or system malfunction.
- (2) The User violates Terms during the rental period.
Chapter 4: Handling of Bicycle Accidents, etc.
Article 19 (Accident Handling)
- 1. In an accident, the User must take legal measures and:
- (1) Immediately notify the police and Service Office.
- (2) Submit required documents/evidence without delay.
- (3) Obtain Company consent before settling with third parties.
- 2. Users resolve accidents at their own responsibility and expense.
Article 20 (Handling of Breakdowns, Theft, etc.)
- 1. Stop use and report any breakdowns or abnormalities to the Service Office.
- 2. Report theft to police and Service Office. Members must pay the prescribed theft penalty.
Article 21 (Handling of Battery Depletion)
In case of battery depletion, notify the Service Office and return the bike to the nearest Port as instructed.
Article 22 (Compensation)
- 1. The Company provides insurance during rental periods with the following coverage limits:
- (1) Death/Disability: 10M yen; Hospitalization: 5,000 yen/day; Outpatient: 2,500 yen/day.
- However, the daily hospitalization benefit is limited to within 180 days from the date of the accident, and the daily outpatient benefit is limited to a maximum of 90 days for outpatient visits occurring within 180 days from the date of the accident.
*The compensation period applies only while riding the Sharing Bicycle and is limited to injuries resulting from sudden and accidental external accidents.
- (2) Liability: Up to 200M yen (Combined Bodily/Property); Litigation: Up to...
- 10M yen; Initial response: 10M yen; Treatment: 500k yen/person. Covers legal liability to third parties while riding.
- 2. Damages exceeding limits are borne by the Member/User.
- 3. Insurance may not cover unreported accidents or those involving rule violations.
- 4. Other policy exclusions may apply; the User bears all such costs.

Chapter 5: Fees
Article 23 (Fees)
- 1. Fees consist of the Base Fee, Extension Fee, and other charges.
- 2. Fees and calculation methods are on the website. Changes are announced one week prior.
Article 24 (Registration Fees)
- 1. Registration Fees include contract fees, optional costs (cards/guides), change fees, and renewal fees.
- 2. Registration fees are non-refundable unless termination is due to Company fault.
Article 25 (Base Fee)
The Base Fee is the recurring charge for the selected plan (monthly/daily/hourly).
Article 26 (Extension Fee)
- 1. Extension Fees apply for usage exceeding the initial time allowed by the plan.
- 2. Charging begins after the initial period ends until return is complete.
Article 27 (Other Fees)
Other fees apply to additional paid services requested by the Member.
Article 28 (Payment of Fees)
- 1. Fees for the current month are due on the designated date of the following month.
- 2. If payment fails, the Company may use alternative settlement methods.
Chapter 6: Responsibility
Article 29 (Periodic Maintenance)
The Company performs periodic maintenance based on internal standards.
Article 30 (Pre-use Inspection)
- 1. Check brakes, steering, tires, bell, panel, and battery before each use.
- 2. Report any damage or defects immediately and do not use the bike.
- 3. Use without reporting implies the bike was in good condition at the start.
Article 31 (Management Responsibility)
- 1. Use and store bikes with the care of a good manager.
- 2. Responsibility lasts from the completion of rental until return.
Article 32 (Prohibited Acts)
Users are prohibited from:
- (1) Letting anyone else use the bike.
- (2) Reckless or drunk driving.
- (3) Disregarding traffic rules.
- (4) Riding in prohibited parks or dangerous areas.
- (5) Obstructing pedestrians.
- (6) Modifying or removing any bike components.
- (7) Parking in prohibited zones, private property, or obstructively.
- (8) Forcing use after a breakdown.
- (9) Using bikes for racing, testing, or towing.
- (10) Excessive occupation (e.g., keeping it home overnight for next day use).
- (11) Riding without a helmet if under 13.
- (12) Web scraping, crawlers, or any acts that burden or disrupt the system.
- (13) Acts contrary to laws or public order.
Article 33 (Handling of Abandoned Bicycles)
- 1. Abandoning a bike leads to liability for removal/storage fees and damages.
- 2. If authorities report abandonment, the User must immediately move the bike and follow legal procedures.
- 3. Members must reimburse the Company for any advanced costs.
Article 34 (Obligation to Return the Sharing Bicycle)
Bikes must be returned in their original condition. Members bear repair or replacement costs for any damage or loss.
Article 35 (Handling of Unreturned Bicycles)
- 1. Failure to return the bike may result in agreement termination and criminal charges.
- 2. Members are liable for all usage fees and recovery costs.
- 3. Liability is waived for non-return due to natural disasters; contact the Service Office immediately.
Article 36 (Liability for Damages)
Members are liable for damages to third parties or the Company, unless not caused by their fault.
Chapter 7: Disclaimer
Article 37 (Disclaimer)
Except in cases of willful intent or gross negligence, the Company’s liability is limited to the amount received from the Member for bike usage.

Chapter 9: Miscellaneous Provisions
Article 39 (Changes to Terms)
Revisions are notified via the website and may be made without prior individual notice.
Article 40 (Notifications, etc.)
Notifications are sent to registered phone/email and are effective upon transmission. Users bear any disadvantage from non-delivery.
Article 41 (Late Payment Charge)
Late payments incur a charge of 14.6% per annum.
Article 42 (Governing Court)
Disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
